Terms of Use
Notice: All Terms of Use contained herein and on previous versions of this site are cumulative and, therefore, previous Terms of Use (The Meyer Law Firm updates its terms of use frequently) are also binding on users of this site and also contain arbitration clauses and class action waivers.
By your use of this or any Meyer Law Firm website, you agree and consent to The Meyer Law Firm’s (“TMLF”) Terms of Use and Privacy Policy set forth herein. All references to “Firm,” “we,” “us,” or “our” refer in this website refer to The Meyer Law Firm, P.C. and/or any other law firm owned or controlled, in whole or in part, by Jeff Meyer. All references to our “websites” (sometimes “site” or “Site”) refer to this website and our other Firm-owned, operated, permitted, authorized or branded websites created, managed, or owned by, for or on behalf of TMLF that include(s) our Terms of Use and Privacy Policy. Any website that links to these Terms of Use is considered a “website.” All references to “you” or “your” refer to any person visiting websites and/or using such websites.
IMPORTANT NOTICE: THESE TERMS OF USE ARE SUBJECT TO BINDING ARBITRATION AND A WAIVER OF CLASS ACTION RIGHTS.
I UNDERSTAND AND AGREE THAT THE SCOPE OF THIS ARBITRATION CLAUSE AND WAIVER OF CLASS ACTION RIGHTS IS BROAD AND I AGREE THAT BY MY USE OF THIS SITE I HAVE AGREED TO THE TERMS OF USE INCLUDING SUCH CLAUSE AND WAIVER. I ALSO AGREE THAT ANY PRE-CHECKED BOX ON ANY WEBSITE SHALL EFFECTIVELY BE CONSIDERED MY ELECTRONIC SIGNATURE CONSENTING AND AGREEING TO THESE TERMS. MOREOVER, THOUGH I AGREE MY USE OF THE WEBSITE ALONE IS CONSENT TO THESE TERMS OF USE, IF I ALSO CLICKED ANY SUBMIT OR SIMILAR BUTTON ON ANY WEBSITE CONTAINING A LINK TO THESE TERMS THAT ALSO CONSTITUTES MY CONSENT AND AGREEMENT TO THESE TERMS.
PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
TMLF and you agree that these Terms of Use affect interstate commerce and that the Federal Arbitration Act governs the interpretation and enforcement of these arbitration provisions.
Except as otherwise specifically set forth below, any dispute, claim, or controversy of any kind between TMLF or any of its lawyers, on one hand, and you, on the other, arising under or relating in any way to these Terms of Use, any communication or contact to you from or on behalf of The Meyer Law Firm, including from any representative or agent of The Meyer Law Firm, or in connection with your access to, and/or use of the Site, and/or the provision of content, services, and/or technology on or through the Site shall be resolved by binding arbitration to be held in Houston, Texas. This expressly includes but is not limited to any claim arising under the Telephone Consumer Protection Act (TCPA).
TO THE EXTENT ANY PORTION OF THIS ARBITRATION AGREEMENT IS NOT ENFORCEABLE, THEN IT WILL BE ENFORCED TO THE MAXIMUM EXTENT TO REQUIRE ARBITRATION EXCEPT CLAIMS BROUGHT BY A CLIENT AGAINST THE FIRM FOR LEGAL MALPRACTICE OR NEGLIGENCE IN REPRESENTING A CLIENT ARE NOT SUBJECT TO ARBITRATION.
The arbitration shall be conducted by a single arbitrator, governed by the Commercial Arbitration Rules (collectively, “AAA Rules”) of the American Arbitration Association (“AAA”), as modified by these Terms of Use, and administered by the AAA. The AAA Rules and fee information are available at www.adr.org.
You shall bear the cost of any arbitration filing fees and arbitration fees. You are responsible for all other additional costs that you may incur in the arbitration including, but not limited to attorney’s fees and expert witness costs unless TMLF is otherwise specifically required to pay such fees under applicable law. The decision of the arbitrator will be in writing and binding and conclusive on TMLF and you, and judgment to enforce the decision may be entered by any court of competent jurisdiction. TMLF and you agree that dispositive motions, including without limitation, motions to dismiss and motions for summary judgment will be allowed in the arbitration. You agree the arbitrator must follow these Terms of Use. TMLF and you understand that, absent this mandatory arbitration provision, TMLF and you would have the right to sue in court and have a jury trial. TMLF and you further understand that, in some instances, the costs of arbitration could exceed the costs of litigation and the right to discovery may be more limited in arbitration than in court.
Class Action Waiver. PLEASE READ THIS SECTION CAREFULLY – IT MAY SIGNIFICANTLY AFFECT YOUR LEGAL RIGHTS.
TMLF and you agree that TMLF and you will resolve any disputes, claims or controversies on an individual basis, and that any claims brought under these Terms of Use in connection with the Site will be brought in an individual capacity, and not on behalf of, or as part of, any purported class, consolidated, or representative proceeding. TMLF and you further agree that TMLF and you shall not participate in any consolidated, class, or representative proceeding (existing or future) brought by any third party arising under these Terms of Use or in connection with the Site or on any matter on which you have agreed to arbitration, including but not limited to claims under the TCPA.
If any court or arbitrator determines that the class action waiver set forth in this paragraph is void or unenforceable for any reason or that arbitration can proceed on a class basis, then any disputes between you and TMLF and/or any of TMLF’s lawyers related to the content or use of this site in any way must be litigated in federal court located in Houston, Texas.
The terms of use will also apply to any claims asserted by you against TMLF but also any claims against any parent or affiliated company of TMLF or any owner of TMLF to the extent that any such claims arise out of or in any way related to or touching on your access to and/or use of the Site, and/or the provision or subject matter of content, services, and/or technology on or through the Site.
